Partner Program Terms of Use (Beta)

These Partner Program Terms of Use (“Partner Terms”) govern participation in Gapwise's Creator Partner Program (“Partner Program”), under which eligible creators (“Partners”) can earn a share of subscription and advertising revenue. The Partner Terms supplement, and are part of, our general Terms of Use. If there's a conflict between the two specifically about the Partner Program, these Partner Terms control.

1. Age & account eligibility

Independent Partner accounts: 18+

To independently apply for, hold, and manage a Partner account — including connecting a payout method and receiving payouts directly — you must be at least 18 years old (or the age of majority in your jurisdiction, if higher).

Creators aged 13–17

You're welcome to publish Artifacts, remix, and take part in the community below age 18. To become a Partner — i.e. to earn and receive payouts — the Partner account must be owned and managed by a parent or legal guardian, under the Parental Account Requirements in Section 2. A minor cannot hold Partner status directly, and cannot connect their own payout method.

Children under 13

Use of Artifact at all — not just the Partner Program — is prohibited for anyone under 13, consistent with our Privacy Policy.

2. Parental account requirements (ages 13–17)

If a creator aged 13–17 wants to participate in the Partner Program, the Partner account must meet all of the following:

• All billing, payout, and tax information (including the connected Stripe Connect payout account) must belong to the parent or legal guardian — never the minor.
• The account's registered email address and legal name on file must belong to the parent or legal guardian.
• The parent or legal guardian must be listed as the account owner on the creator's public profile. The minor's chosen display name/handle can still be used for the creative identity, but account ownership must be disclosed.
• The parent or legal guardian is the person who accepts these Partner Terms, and is legally responsible for all activity on the account — including published content, remix settings, and earnings.

We may ask for verification of the parent/guardian relationship before approving or continuing Partner status for an account in this category, and can suspend Partner status (not necessarily the underlying account's ability to publish/remix) if these requirements aren't met or stop being met.

3. Applying & maintaining Partner status

Partner eligibility criteria (publishing history, activity thresholds, standing) are described on our Partners page and may change over time. Meeting the eligibility criteria doesn't guarantee approval, and approval doesn't guarantee any particular amount of earnings. We review applications and may approve, deny, or request more information at our discretion.

4. Grounds for suspension or revocation

Beyond the general Acceptable Use rules in our main Terms, the following specifically put Partner status — and, in serious or repeated cases, the underlying account — at risk:

• Duplicating another creator's Artifact — its source, configuration, or the prompts used to build or remix it — outside the platform's own remix feature, and republishing it as your own original work. Using the built-in remix flow (which preserves attribution and lineage back to the original) is always fine; extracting someone else's work to strip that attribution is not.
• Misrepresenting authorship of an Artifact, or publishing assets (images, code, written content) you don't have the rights to use.
• Artificially inflating views, remixes, saves, reactions, or subscriber counts — including via bots, coordinated rings, or self-dealing accounts — to increase Partner earnings.
• Circumventing or helping others circumvent the premium-access paywall.
• Harassment, hate speech, or abusive conduct directed at other creators, in comments or elsewhere on the Service.
• Publishing an Artifact containing malicious code (malware, data exfiltration, deceptive scripts).
• Creating additional accounts to evade a suspension or ban on an existing one.
• Repeated, confirmed copyright infringement — see Section 5.
• For accounts in the 13–17 category: the Parental Account Requirements in Section 2 no longer being met.

5. Repeat infringer policy

Consistent with our obligations around copyright, we terminate Partner status — and may terminate the underlying account — for creators who are the subject of repeated, confirmed copyright infringement notices under our copyright complaint process, regardless of whether the infringing material was original to their account or introduced through a remix.

6. What happens when Partner status is suspended or revoked

• Suspension/revocation affects Partner (earning) status specifically — it doesn't automatically mean your general account or published Artifacts are removed, unless the underlying conduct also violates the general Terms of Use.
• Earnings already paid out aren't automatically clawed back, except in cases of confirmed fraud.
• Pending, unpaid earnings may be withheld while we investigate a suspected violation.
• A revoked Partner may re-apply after 30 days, except in cases involving fraud, repeated copyright infringement, or harm to another creator, which may be permanent.
• A record of past bans is retained even if a suspension is later lifted, and factors into future Partner eligibility.

7. Changes to these Partner Terms

We may update these Partner Terms from time to time. For material changes — especially anything affecting how earnings are calculated or paid — we'll give Partners notice before the change takes effect.
